1. INTRODUCTORY PROVISIONS

1.1. These Terms and Conditions of the business company branches & potatoes, with its registered office at Počernická 467/44, Prague 10, Czech Republic, Identification Number (IČ): 29496055, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 447485/MSPH (hereinafter referred to as the "Seller"), govern the mutual rights and obligations of the contracting parties arising in connection with or on the basis of a purchase agreement concluded between the Seller and another natural person (hereinafter referred to as the "Buyer") via the Seller's online store at www.bomeoi.shop.

1.2. These Terms and Conditions are intended exclusively for consumers. Purchases made by entrepreneurs (using a business ID/IČO) are governed by the statutory provisions of the Civil Code applicable to relations between entrepreneurs, and these Terms and Conditions apply to them only to the extent that does not contradict the law.

1.3. The subject of sale consists primarily of books, notebooks, and complementary assortments (hereinafter referred to as the "Goods").

2. USER ACCOUNT

2.1. Based on registration, the Buyer can access their user interface, from which they can place orders. Registration is not a prerequisite for making a purchase.

2.2. The Buyer is obliged to provide correct and truthful information. The Seller considers the information provided in the order to be correct.

2.3. Access to the account is secured by a username and password. The Buyer must not provide these access details to third parties.

3. CONCLUSION OF THE PURCHASE AGREEMENT

3.1. Information about the Goods, including prices and shipping costs, is provided in the store interface. The prices are final, including VAT.

3.2. The Buyer places the Goods into the shopping cart and selects the shipping and payment method.

3.3. Before submitting the order, the Buyer has the opportunity to check and modify the data. The Buyer submits the order by clicking the "ORDER BINDING TO PAYMENT" button. By taking this step, the Buyer confirms being aware of the obligation to pay for the Goods.

3.4. The purchase agreement is concluded at the moment the Seller delivers the confirmation of receipt of the order to the Buyer's email address.

4. PRICE, PAYMENT, AND TRANSPARENT DISCOUNTS

4.1. The Buyer can pay the purchase price using the methods specified in the shopping cart (cash on delivery, card online, bank transfer).

4.2. If the Seller indicates a discount for the Goods (e.g., clearance sale), the Seller shall also indicate the lowest price at which the Goods were offered and sold during the 30 days prior to the provision of the discount.

4.3. In accordance with the sustainability policy for the year 2026, a minor recycling fee or a fee for sustainable packaging may be added to the price if so indicated in the shopping cart.

5. WITHDRAWAL FROM THE AGREEMENT (RETURNS)

5.1. The Buyer has the right to withdraw from the agreement without giving any reason within 14 days of receiving the Goods.

5.2. In accordance with Section 1837 of the Civil Code, it is not possible to withdraw from the agreement for Goods that have been customized according to the wishes of the Buyer or for their person (e.g., with name embossing, a product with a personal dedication by the author at the customer's request, etc.).

5.3. If the Buyer withdraws from the agreement, the Buyer shall bear all costs associated with returning the Goods to the Seller (return postage) in full.

5.4. The Seller will refund the money within 14 days of withdrawal, but not before receiving the returned Goods or proof of their shipment.

5.5. The Seller is entitled to unilaterally offset any claim for damage caused to the Goods against the Buyer's claim for a refund of the purchase price.

5.6. The Buyer is liable to the Seller for any reduction in the value of the Goods resulting from handling the Goods in a manner other than what is necessary to familiarize themselves with the nature, characteristics, and functionality of the Goods (e.g., if the product is written in, has damaged pages, or a damaged binding). In such a case, the Seller is entitled to deduct an amount corresponding to the reduction in the value of the Goods from the refunded amount.

6. DELIVERY CONDITIONS AND DIGITAL PASSPORTS

6.1. The Goods are delivered to the address specified by the Buyer. The risk of damage to the Goods passes to the Buyer at the moment of receipt.

6.2. The Seller strives to minimize environmental impact. For selected Goods (especially premium diaries), a so-called Digital Product Passport (in the form of a QR code) may be included in the packaging, containing information on the origin of the paper (FSC/PEFC certification) and recycling instructions.

7. CLAIMS (RIGHTS FROM DEFECTIVE PERFORMANCE / WARRANTY)

7.1. The Seller is responsible for ensuring that the products are free of printing defects (e.g., missing or jumbled pages) and are mechanically in order.

7.2. If a defect manifests within 12 months of receipt, it is presumed that the Goods were already defective upon receipt.

7.3. The Buyer may claim a defect that appears on the Goods within 24 months of receipt.

7.4. The Buyer has the right to have the defect removed (replacement with a new item or repair). If this is not possible, the Buyer has the right to a discount or to withdraw from the agreement. The claim will be settled no later than 30 days from its filing.

8. USER REVIEWS

8.1. The Seller only publishes reviews on the e-shop from customers who have actually purchased the Goods. Authenticity is ensured by a technical link between the review form and a specific order ID.

9. OUT-OF-COURT DISPUTE RESOLUTION

9.1. The Czech Trade Inspection Authority (Česká obchodní inspekce - www.coi.cz) is competent for the out-of-court settlement of consumer disputes. For online dispute resolution within the EU, the platform at http://ec.europa.eu/consumers/odr can be used.

10. FINAL PROVISIONS

10.1. These Terms and Conditions are governed by Czech law.

10.2. By submitting the order, the Buyer confirms that they have familiarized themselves with these Terms and Conditions and agree to them.

These Terms and Conditions are valid and effective as of April 30, 2026.
